Before bidding at Irish Machinery Auctions, please ensure you have read the below auction terms and conditions of sale for this auction. All terms and conditions must be accepted by both parties before participating in the auction process. If you have any question, please ask a member of staff, they are always willing to help you. Bidding Registration and Deposit – In order to be able to bid at auction you will need to register your details at the registration office or on the Irish Machinery Auctions website by cliking register to bid and completing the forms, you will also be required to place a €1000 Debit Card, Bank Draft or Bank Transfer deposit. This is fully refundable if you don’t buy anything. If you fail to pay your invoice in full your deposit will automatically be forfeited and will not be refunded. Your details will be held and you will receive notification of upcoming auctions. If you fail to pay the deposit, you will not be approved to bid at the auction. N.B. If your deposit is paid with a credit card you will incur a charge of 2.5% +VAT, whether you make a purchase or not. This amount will not be refunded. All bidding deposits for unsuccsessful bidders will be refunded on Friday, once BOTH online auctions have been completed in full. As with any Debit/Credit card refunds, this can take up to 3 to 5 working days to be processed back into your account by your own bank which is outside Irish Machinery Auctions control. Provisional Bids – If your bid placed is less than the reserve set by the vendor, the bid will be considered to be ‘provisionaly’ sold when bidding is complete. The office will then inform the vendor of the highest bid reached, and they will be given the option of accepting or declining the bid after the auction. in this case your deposit will be held until the vendor confirms if they are to accept or reject the offer. The item may be displayed as not sold on the website, but this is not a confirmation that the bid has been rejected, only when an Irish Machinery Auctions member of staff has contacted you and confirmed the outcome of your bid wil you be able to proceed. Commission – Auctioneer’s commission will be charged on all lots purchased. Please find below rates of buyer’s commission: (Please note all lots are subject to 23% VAT on the Hammer Price) Assets sold up to €5,000 12% commission plus VAT Assets sold €5,001 - €10,000 10% commission plus VAT Assets sold €10,001 - €25,000 7.5% commission plus VAT Assets sold over €25,001 5% commission plus VAT *Minimum Charge of €50 +VAT on any Road Registered Vehicles **Minimum Charge of €10 +VAT on all other lots *** Admin Charge of €10 +VAT on all lots VAT is charged at the standard rate of 23% on ALL ITEMS SOLD. N.B. There is a buyer surcharge for using the following payment methods all other forms of payment will incur no surcharge: Cash – 0.7% +VAT I.E. €100 cash surcharge = 0.86c Credit Card – 2.5% +VAT I.E. €100 Credit Card Surcharge = €3.08 IMPORTANT VAT EXPORT NOTE: The VAT on any assets being exported MUST BE PAID IN FULL and once we have proof of export AND we are refunded the VAT, we will then refund the VAT to the customer. IT WILL BE APPROXIMATELY 8 WEEKS before we are refunded and refund you. Full details of requirements are noted on page 5. Payment Terms – Payments can be made by Cash, Same Day Bank Transfer, Debit Card or Bank Draft. Payment will need to be received by 5pm Monday following the Auction. Same day bank transfers will need to be received in our bank account by this deadline also. Collection of goods – Only when payment has been made in full and you have received a ‘paid in full invoice’, can assets be removed from the premises. All assets must be paid for in full and removed from the premises by 5pm Tuesday following the Auction. If not collected, there will be a storage charge of €20 per lot purchased per day. All necessary equipment, labour etc for removal of assets from the premises will need to be organised and paid for by the purchaser. Material handling equipment with a driver will be available. Irish Machinery Auctions or any person working for or on behalf of either company will be responsible for any loss or damage to goods during or after the auction or during loading or transportation. Loading may be refused at the discretion of Irish Machinery Auctions. Logbooks – Please note some of the vehicles and machinery have never been used on the road so there will be no log book or paperwork supplied when purchased. The onus is on the purchaser to register, if needed Vehicles that haven’t been already road registered. Important Notes – ALL ASSETS ARE SOLD AS SEEN. Purchasers must satisfy themselves with the condition of the assets before bidding on them. All assets are sold with all faults, imperfections and errors of description. No warranties are given or implied, and no complaints will be entertained. Great care has been taken to ensure the catalogue is accurate, however the auctioneers and their staff shall not be held responsible for any errors or mistakes made in relation to quantities, descriptions or measurements. It is the responsibility of the purchaser to inspect and satisfy themselves with the lots. The auctioneer reserves the right to reject or refuse any bid without reason. No bidding shall be retracted by the bidder. The auctioneer reserves the right to bid on behalf of any vendor. If you fail to agree to any of the terms and conditions you will be liable for any loss of commission and any shortfall in the hammer price upon the resale of the lots you have purchased. In order to bid at any auction, bidders will need to have registered their details at the registration office and placed a deposit to the value specific to that auction, noted on the specific auction terms and conditions. This deposit will be fully refundable if no goods are purchased. If a bid is placed less than the reserve set by the vendor, this will be a ‘provisional sale. The highest bidder of each lot will be the purchaser, and therefore will be required to pay the hammer price, plus commission and any VAT. If there is a dispute, the auctioneer will have absolute discretion to settle the dispute or to re offer the lot. All goods purchased shall be paid by COB two working days following the auction, unless otherwise specified in the specific auctions terms and conditions. Only when payment has been made in full and you have received a ‘paid in full’ invoice, can the assets be removed from the premises. Where these goods are not collected by the auction deadline, there will be a storage charge. All necessary equipment, labour etc for removal of assets from the premises will need to be organised and paid for by the purchaser. Any goods left on site are done so at the risk of the purchaser (following the auction) and vendor (before the auction and if goods are not sold at auction) for loss, damage or destruction thereby arising. Irish Machinery Auctions reserve the right to re sell without warning any items unpaid 6 days after the sale. On these occasions, your deposits will be forfeited, and you will be liable for all associated costs including lost commission, costs of resale and shortfall on subsequent sale. The auctioneers are prepared to accept commission bids on behalf of intending purchases who are not able to attend the auction. These bids will be required to be given in writing, and will be free of charge. These purchases will be subject to the same commissions, and terms and conditions as any other purchasers. The purchaser shall be liable for any damage done to the premises on removal of goods from the premises. The auctioneer or the vendor do not accept responsibility for duties (if any) by the Health & Safety Act 1974 or any other statutory provisions, and responsibility will be held by the purchaser to ensure that all the statutory requirements are complied with. Health and Safety regulations require that any persons under the age of 16 years to be accompanied by a parent or guardian. All purchases must be made by Cash, Same Day Bank Transfer, Debit Card or Bank Draft. Payment will need to be received by 5pm two working days following the auction. Same Day Bank Transfers will need to be received in the company’s bank account by this deadline also. All Lots are sold as seen and with all faults and imperfections and errors of description. Illustrations, descriptions and years in catalogues or brochures are for identification only. Descriptions in each case are provided by the Vendor. All Lots are available for inspection and Purchasers should satisfy themselves prior to the Auction as to the condition of each Lot and should exercise and rely on their own judgement as to whether the Lot accords with its description. The Purchaser of any Lot is deemed to have inspected the Lot prior to purchase. The Auctioneer gives no warranty as to the description, condition, year or otherwise in relation to any Lot and all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from the Agreement. Each and every Lot shall be sold ‘as is, where is’. Specifically, but without limitation, Auctioneer makes no representation or warranty that any of the Lots: a. Conform to any standard in respect of safety, pollution or hazardous material or to any standard of requirement of any applicable authority, law or regulation, or b. Are fit for any particular purpose, or c. Are merchantable or financeable, or d. Are of any particular age, year of manufacture, model, make or condition. The purchaser agrees he has satisfied himself and is not relying on the Auctioneer, nor is the Auctioneer liable, for any matter in respect of the above. Bidder further agrees to repair, at his cost, any Lot purchased at the Auction to a safe operating condition and, without limitation, to a condition which meets any standard or requirement of any applicable authority, law or regulation including those concerning any use to which the Lot may be put. Great care has been taken in ensuring the catalogue is accurate, however the auctioneers and their staff shall not be held responsible for any errors or mistakes made in relation to quantities, descriptions or measurements. The purchaser is deemed to have acquainted themselves with their purchase before bidding and therefore no concessions will be made for any fault, damage, imperfection or error discovered after purchase. All Lots are sold without CE Marking unless specified otherwise. If any Lot has been described as CE Marked, the Purchaser acknowledges that this description has been provided by the Vendor. The Auctioneer makes no warranty as to the accuracy or authenticity of any CE Marking on any Lot. Exporting Goods Purchased at Auction Within The E.U. If purchasing goods at auction that you wish to export out of the country you will need to provide the following paperwork to the office: Company Name and Address within The E.U Company VAT registration certificate. Photo ID for Managing Director. Passport or Driving Licence. Proof the goods have been exported from the country -Must show clearly serial number or registration number of the items exported. A declaration on company headed paper stating the lots you have purchased and where they have been exported and how they have been transported, signed by a director of the company. In the case of goods exported by sea by a carrier acting on behalf of a supplier, the supplier should ensure that he or she obtains from the shipping company a copy bill of laden or certificate of shipment or shipping advice, as appropriate. In the case of goods exported by air by a carrier acting on behalf of a supplier, the supplier should ensure that he or she obtains from the airline concerned a signed copy of the waybill with flight details added. In the case of goods exported by post the supplier should obtain certificates of posting from the post office of dispatch. If it is a trader’s practice to use a post book the trader should have it properly stamped by the post office of dispatch. In all cases the full name and address of the consignee must be clearly shown. VAT REFUNDS CANNOT BE PROCESSED FOR CUSTOMERS WHO TRANSPORT THEIR OWN GOODS. Important Note: You must pay your invoice IN FULL INCLUDING the VAT and once all the above paperwork is supplied to Irish Machinery Auctions and we are satisfied it is all correct, you will be refunded the VAT amount on the hammer price ONLY.
